Description/Analysis

 

Issue Detail: On November 8, 2018, the Sacramento City Council authorized acceptance of the Fiscal Year (FY) 2018 Urban Area Security Initiative Grant (Resolution 2018-0434). The purpose of the grant is to prepare the United States for the threats and hazards that pose the greatest risk by supporting state and local efforts to prevent terrorism and other catastrophic events. The grant provides funding to implement investments that build, sustain, and deliver core capabilities essential to achieving the National Preparedness Goal, which is to have a secure and resilient nation with the capabilities required across the whole community to prevent, protect against, mitigate, respond to, and recover from the threats and hazards that pose the greatest risk. 

 

This grant program requires 25 percent of funding be used for Law Enforcement Terrorism Prevention Activities (LETPA). To meet this requirement, the Sacramento Police Department (SPD) seeks City Council authorization to pass through federal grant funds to the Sacramento County Sheriff’s Department for the staffing of the Central California Intelligence Center (CCIC) - Regional Threat Assessment Center (RTAC) to carry out the duties of intelligence analysis, information sharing, regional collaboration, law enforcement investigations, and terrorism awareness and training.

 

Policy Considerations: The recommendations contained in this report are consistent with Sacramento City Code 3.56.090, which requires City Council approval to award a contract of $250,000 or more. This item is not subject to competitive bidding requirements as it does not meet the definition of a procurement action as defined at Title 2, Part 200, Section 330 of the Code of Federal Regulations (2 CFR 200.330).

California Environmental Quality Act (CEQA):  This action concerns administrative and professional activities that will not have a significant impact on the environment, and therefore, does not constitute a “project” as defined by the CEQA Guidelines, per Sections 15061(b)(3) and 15378(b)(2).

Rationale for Recommendation: Section 2006 of the Homeland Security Act of 2002, as amended (6 USC § 607), requires that 25 percent of funding awarded under this program must be used for Law Enforcement Terrorism Prevention Activities (LETPA). The services described in this agreement align with the allowable activities as described in 6 USC § 607(2)(A), (G), and (H). As defined in 6 USC 124(j), a “fusion center” is defined as “a collaborative effort of two or more federal, state, local, or tribal government agencies that combines resources, expertise, or information with the goal of maximizing the ability of such agencies to detect, prevent, investigate, apprehend, and respond to criminal or terrorist activity.”

 

The fusion center for the Sacramento region is the Central California Intelligence Center - Sacramento Regional Threat Assessment Center (RTAC). The RTAC serves as a clearinghouse for intelligence analysis and information sharing for crimes and all hazards for the Eastern District of California. The RTAC is designed to be an analytically driven fusion center that supports law enforcement information needs with an emphasis on terrorism intelligence. The Terrorism Liaison Officer Program, Federal Bureau of Investigations (FBI) - InfraGard Program, and the FBI’s Joint Terrorism Task Force missions are also merged with the RTAC.

 

The subaward will staff the following positions at the RTAC:

 

                     Critical Infrastructure Program Analysts (2)

                     Cyber Intelligence Analyst (1)

                     Deputy Directors (2)

                     Executive Director (1)

                     Fusion Center Sheriff Records Officer I (1)

                     Fusion Center Sheriff Records Officer II (1)

                     Lead Crime and Intelligence Analysts (2)

                     Terrorism Liaison Officer Program Support (2)

 

This agreement will meet the LETPA 25 percent program requirement and will support the National Preparedness Goal by providing staffing to operate and carry out the mission of the RTAC successfully.

 

Financial Considerations:  This action will be fully funded through existing grant resources (Project #G11016918) and will not have any financial impact to the General Fund.
