Description/Analysis
Issue Detail: Staff recommends Council approve agreements with Tidal Marine Construction, Inc. and Underwater Resources, Inc., each for an amount not-to-exceed $500,000, for On-Call Underwater Diving and Remote Operated Vehicle (ROV) services to support Department of Utilities (DOU) Drinking Water and Stormwater facilities.
Policy Considerations: City Council approval is required for service agreements of $250,000 or more per City Code 3.64.020.
Economic Impacts: None
Environmental Considerations: Per the California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3), approval of the proposed Agreements is exempt from the CEQA, under the common sense exemption that CEQA only applies to actions with potential to significantly affect the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on an environmental resource, the activity is not subject to CEQA. Approval of these Agreements will not affect the environment. Work to be conducted under the agreements has been determined to be exempt from CEQA pursuant to CEQA Guidelines Sections 15301 and 15309 (Existing Facilities and Inspections). The work consists of the operation, repair, maintenance and minor alteration of existing facilities and mechanical equipment and inspections to check for performance of an operation, or quality, health, or safety of a project.
Sustainability: The proposed contracts are consistent with the 2035 General Plan as they improve infrastructure reliability and sustainability by providing supporting services that help continue operations and improve operations of various facility systems.

Rationale for Recommendation: On February 19, 2020 Request for Qualifications (RFQ) Q20141311013 was issued for On-Call Underwater Diving and ROV Services for Drinking Water and Stormwater Facilities.
On the due date of Wednesday, March 18, 2020, proposals were received from the following 5 firms: DRS Marine, Harbor Offshore, Hiuga Diving, Tidal Marine, and Underwater Resources. The proposals were evaluated and scored by a three-member evaluation team that included staff from DOU.
Scores were tabulated and totaled with the proposals from Tidal Marine Construction, Inc. and Underwater Resources, Inc. having the highest and second highest scores, respectively.
Financial Considerations: The proposed on-call agreements have an initial three-year term, with two optional one-year renewals. Each agreement has a not-to-exceed amount of $500,000 for the maximum five-year term. The total expense for both agreements for the full five-year term will be $1,000,000.
There is sufficient funding for the first year in the Fiscal Year 2020/21 DOU Operating Budget. Funding of this agreement in future fiscal years will be subject to availability of sufficient funds in the budget adopted for the applicable fiscal year.
There are no General Funds planned or allocated for this project.
Local Business Enterprise (LBE): Tidal Marine Construction, Inc. and Underwater Resources, Inc. are not LBE’s. The minimum LBE participation requirement was waived by the Director of Utilities based on a determination that waiver is in the City’s best interest due to the lack of qualified local vendor availability.
Background: The City of Sacramento has drinking water and stormwater facilities that require underwater diving and ROV services for investigation, cleaning, and repair. They include four river intakes, eleven reservoirs, a Ranney Collector well (13-ft internal diameter well), and more than 150 miles of transmission mains. Twice a year, underwater maintenance is required at the drinking water intakes of both treatment plants where they are cavi-blasted from the facility side of the screens. When deficiencies are noticed, additional cleaning from the river side of the screens, or minor repairs, may be required. Each year, the two stormwater intakes need to be inspected and relieved of debris, where there is a potential for minor repairs to be required.
On-call diving and ROV services include, but are not limited to, the following:
• Underwater cleaning, inspection, and repairs of the intake fish screens (from the river or the facility side) at E. A. Fairbairn Water Treatment Plant (Fairbairn) and Sacramento River Water Treatment Plant (SRWTP);
• Underwater inspection, debris removal, and repairs of the stormwater intakes at Pioneer Reservoir and Sump 132;
• Underwater sand removal within the intakes for Fairbairn and SRWTP;
• Underwater repair of equipment at Fairbairn and SRWTP;
• Underwater cleaning, inspection, and repairs of the water distribution storage reservoirs and water treatment facilities;
• Internal inspection of active and inactive water pipelines; and
• Underwater inspection and repairs of the Ranney Collector well.
