Description/Analysis
Issue Detail: On September 10, 2020, the City Manager, acting as the Director of Emergency Services during the COVID-19 pandemic, issued Emergency Order 2020-006 to mitigate the effects of the COVID-19 emergency on local athletic clubs/fitness studios, commercial services, and retail stores. The City Manager issued rules and regulations to temporarily allow the use of private parking lots for business activities including product shelving, exercise equipment, and specific tools necessary in the trade to provide service to the customer consistent with zoning and County health. This action includes a revised encroachment permit to allow the same business activities within approved areas of the public right-of-way.
Policy Considerations: Sacramento City Code section 2.116.060.A. provides for the declaration of a local emergency. On March 13, 2020, the City approved a resolution declaring a local emergency in response to the spread of COVID-19. Section 2.116.060 also authorizes the City Manager, as Director of Emergency Services, to make and issue rules and regulations on matters related to a local emergency.
