Issue Detail: Staff recommends Council approve an agreement with Twining, Inc., for on-call inspection services for various utility infrastructure improvement projects. Many Department of Utilities (DOU) projects require specialized inspection expertise on various project components such as structural, mechanical, electrical, and drinking water systems that could include, but are not limited to, improvements at treatment plant facilities, storage tanks, pump stations, groundwater wells and associated infrastructure, electrical control systems, steel/concrete repairs, and water transmission mains.
Each year, DOU performs millions of dollars in construction projects which include repairing/replacing existing infrastructure, modifying existing systems, and the construction of new systems to support the utilities. Much of the construction is supported by in-house City inspectors; however, many DOU projects include more specialized construction that require special inspection to ensure the improvements are completed correctly and in a timely manner. Specialized inspectors are also needed to enter confined spaces, witness equipment testing, and confirm complex regulations are being met.
Policy Considerations: City Council approval is required for professional service agreements of $250,000 or more per City Code 3.64.020.

Environmental Considerations: The proposed agreements for on-call inspection for utility infrastructure have been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines. Section 15061(b)(3) consists of activities covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on an environmental resource, the activity is not subject to CEQA. The activity would also be exempt pursuant to CEQA Guidelines Section 15309 (Inspections), which consists of activities limited to inspections, to check for performance of an operation, or quality, health, or safety of a project.
Sustainability: The proposed project is consistent with the 2035 General Plan by improving infrastructure reliability, which will prolong the useful life of existing utility infrastructure and ensure that utility systems will remain at a high level of service.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: On June 2, 2020, a Request for Qualifications (RFQ) (#Q20141311017) was advertised and issued on PlanetBids for On-Call Specialty Inspection Services. On the due date of June 22, 2020, three Statements of Qualifications (SOQs) were received from the following firms: Apex Testing Laboratories, MatriScope Engineering, and Twining Inc.
A three-member evaluation team that included staff from DOU, evaluated the proposals. On August 5th and 6th, 2020, e-meeting interviews were conducted with Apex Testing Laboratories and Twining, Inc. Apex Testing Laboratories and MatriScope Engineering were deemed not to have the experience needed to meet the scope of services and thus Twining Inc. was deemed to be the only qualified firm.
Financial Considerations: The proposed on-call agreement has an initial three-year term, with a maximum of two additional one-year renewals. Twining, Inc. may have multiple task orders within a year; however, the total not-to-exceed amount is $900,000 for the maximum five-year term. Services under this agreement are intended to be used to fill needs when demand warrants.
There is sufficient funding for the first year in the DOU Fiscal Year 2020/21 approved Capital Improvement Program budget. Purchase orders encumbering funds under these agreements will not be created until projects and funding are identified. Funding in future fiscal years will be subject to availability of sufficient funds in the budget adopted for the applicable fiscal year.
