1) Adopt a Resolution authorizing the City Manager or the City Manager’s designee: a) to apply and sign for on behalf of the City, a Financial Assistance Grant Application for an agreement with the State Water Resources Control Board (SWRCB) for the construction of the Sump 85 Reconstruction Project in an amount up to $9,402,000; b) to provide the assurances, certifications and commitments required for the grant application, including executing a financial assistance agreement from the SWRCB and any amendments to changes thereto; c) to represent the City in carrying out the City’s responsibilities under the financing agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws; and d) to establish the revenue and expenditure budgets, if awarded, in the Wastewater Sump Replacement and Rehabilitation Project (X14130900) in the Wastewater Grant Fund (Fund 6206) for the awarded grant amount; and 2) adopt a Resolution declaring the City of Sacramento official intent to reimburse obligations related to the Clean Water State Revolving Fund Grant Program

Description/Analysis

 

Issue Detail:  The City of Sacramento’s (City) Department of Utilities (DOU) is seeking approval to apply for grant funding through the State Water Resources Control Board (SWRCB), Clean Water State Revolving Fund (CWSRF) Grant Program for the City’s Sump 85 Reconstruction Project.

 

California’s CWSRF Program is authorized under California Water Code Sections 13475-13485 and operates pursuant to an Operating Agreement between the State Water Board and the United States Environmental Protection Agency (U.S. EPA) Region 9 supporting the Federal Clean Water Act and is a tool to finance the protection and improvement of water quality. The CWSRF Program has protected and promoted the health, safety, and welfare of Californians since 1989.

 

The City is applying for the CWSRF Grant to fund its Sump 85 Reconstruction Project. Established in 1950, the age of Sump 85 has worsened and is suffering from outdated electrical and mechanical equipment, which increases the chance of failure, leading to the possibility of sanitary sewer overflows (SSO's) in the upstream pipes.  SSO's contain high levels of suspended solids, pathogenic organisms, toxic pollutants, nutrients, oil, and grease which pollute surface and ground water, threaten public health, adversely affect aquatic life, and impair the recreational use and aesthetic enjoyment of surface waters.  If awarded, the funds will be used to demolish the existing pump station, construct a new pump station at a new location including updating the electrical, mechanical, plumbing and fencing. 

 

Policy Considerations: City Council Resolution 2019-0248 requires City Council approval to apply for operating grants for more than $250,000.

 

Economic Impacts: None

 

Environmental Considerations: The application for grant funding is an activity that is not a project pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15378(b). The fiscal management of the DOU’s CIP is an ongoing administrative fiscal activity and is not subject to CEQA pursuant to CEQA Guidelines Section 15060(c)(3). Prior to any future work that may occur as part of the Sump 85 Reconstruction project, environmental review in compliance with the requirements of CEQA will be completed and presented to City Council prior to taking action on the project.

 

Sustainability: If awarded, the project to be constructed by the grant funding is consistent with the City's 2035 General Plan as it reduces sewer outflows, improves service, and improves infrastructure reliability, which will, in turn, reduce energy-intensive maintenance.

 

Commission/Committee Action: Not Applicable

 

Rationale for Recommendation:  Adopting the resolutions meets the requirements of the CWSRF Grant Program and will allow the City to successfully apply for this grant opportunity.

                     

Financial Considerations: DOU is seeking up to $9,402,000 in grant funding to fund the Sump 85 Reconstruction Project from the CWSRF managed by the SWRCB.  If awarded, the revenue and expenditure budgets will be established in the Wastewater Sump Rehabilitation and Replacement Program (X14130900) in the Wastewater Grant Fund (Fund 6206) for the awarded grant amount.

 

There are no General Funds allocated for this project.
