Adopt a Resolution: 1) authorizing the City Manager or the City Manager’s designee to execute Supplemental Agreement No. 1 to City Agreement 2019-1015 with UNICO Engineering for construction management services including resident engineer, inspection, public outreach, and material testing services for the 3rd Street Sewer Relief Project, for an amount not-to-exceed $727,776, bringing the agreement’s total not-to-exceed amount to $2,483,366 and extending services to January 1, 2022; and 2) approving a budget transfer of $727,776 from the Sewer Development Fee Fund (Fund 6002) available fund balance to the 3rd Street Sewer Relief Project (X14010000, Fund 6002).

Description/Analysis

 

Issue Detail: Staff recommends Council approve Supplemental Agreement No. 1 with UNICO Engineering, for construction management (CM) services including resident engineer, inspection, public outreach, and material testing services for the 3rd Street Sewer Relief Project.

 

Initially, the City of Sacramento (City) estimated 220 working days for construction of the 3rd Street Sewer Relief Project, however, when the final design was completed, it was determined that there were not enough working days in the construction contract.  Subsequently, the working days were updated to 372. The project was awarded to UNICO Engineering prior to the working days being updated in the final construction contract.

 

Throughout the construction, project change orders have added a total of 49 additional working days to the contract, bringing the total number of working days to 421.

 

The additional working days for the construction contract require that additional capacity be added to the construction management agreement and that the date of the agreement be extended.

 

Policy Considerations:  The proposed supplemental agreement exceeds the City Manager’s approval authority, requiring Council approval.  This work is consistent with the criteria set forth in the Department of Utilities (DOU) Capital Improvement Project Programming Guide to rehabilitate, replace, and expand critical infrastructure to ensure reliability and safety.  

 

Economic Impacts:  None.

 

Environmental Considerations:  On June 11, 2019, the City Council adopted the 3rd Street Relief Sewer System Addendum to the City of Sacramento Combined Sewer System Rehabilitation and Improvement Plan Environmental Impact Report (Resolution No. 2019-0240). The subject action is a continuation of the approved 3rd Street Relief Sewer Project evaluated within the Addendum. No further environmental review is required.

 

Sustainability:  The proposed project is consistent with the 2035 General Plan as it improves infrastructure reliability and supports the City’s Long-Term Control Plan to rehabilitate the Combined Sewer System (CSS) to decrease flooding, outflows, and overflows.

 

Commission/Committee Action:  Not applicable.

 

Rationale for Recommendation:  UNICO Engineering has provided construction management (CM) and coordination that have resulted in cost and schedule saving measures of the 3rd Street Sewer Relief Project. The original not-to-exceed amount of the Construction Management agreement was based on an estimated number of working days that has since been modified due to changes in the construction contract. 

 

There is currently $609,932 of unobligated funds in the project, however, this amount has been earmarked for future potential change orders that may arise during the remaining construction of the 3rd Street Relief Sewer Project.

 

Financial Considerations:   The original not-to-exceed amount of the agreement was $1,755,590.  The proposed Supplemental Agreement No. 1 in the amount of $727,776 would increase the agreement not-to-exceed amount to $2,483,366.  Staff recommends a transfer of $727,776 from the Sewer Development Fee Fund (Fund 6002) available fund balance to the 3rd Street Sewer Relief Project (X14010000, Fund 6002).

 

There are no General Funds allocated or planned for this project.

 

Local Business Enterprise (LBE):   UNICO Engineering is not an LBE, but has partnered with KMP Strategies, LLC and Twining Incorporated for this agreement to exceed the minimum LBE participation requirement. KMP Strategies, LLC is providing public outreach services. Twining Incorporated is providing materials testing services.
