Description/Analysis
Issue Detail: In 2018, the Department of Utilities (DOU) entered into City Agreement 2018-0218 with Water Quality & Treatment Solutions, inc. (WQTS) for assistance with reporting for consumer confidence and public health goals, regulatory monitoring and compliance, assessment of drinking water regulations, evaluation of water quality issues, drafting of technical reports, and to provide on-call technical support services.
The current agreement expired on December 30, 2020. City Staff recommends approval of Supplemental Agreement No. 1 to continue these services through December 31, 2022.
Policy Considerations: This supplemental agreement exceeds the City Manager’s approval authority and requires Council approval.
Economic Impacts: None.
Environmental Considerations: The proposed supplemental agreement is not considered a “project” under the California Environmental Quality Act (CEQA) Guidelines. The approval of a supplemental agreement for regulatory monitoring and compliance, assessment of drinking water regulations, evaluation of water quality issues, drafting of technical reports, and providing on-call technical support services is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment [CEQA Guidelines section 15378 (b)] and is not subject to CEQA (CEQA Guidelines Section 15060(c)(3)].
Sustainability: The proposed project is consistent with the 2035 General Plan as it improves and protects drinking water and its sources.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: On December 8, 2017, Request for Proposal (RFP) (P18141311004) was advertised and issued on PlanetBids for drinking water regulatory, operational and technical support. One response was received from WQTS. Staff reviewed the proposal and based on their knowledge, expertise, and experience, WQTS was selected to provide the requested services.
Staff has been very happy with the work WQTS has performed to date and Supplemental Agreement No. 1 will allow the City to continue with the operation and technical support of WQTS through December 31, 2022. This support is vital in assisting the City with compliance of all state and federal drinking water quality regulations.
Financial Considerations: Supplemental Agreement No. 1 will increase the contract amount by $193,980, for a revised total not-to-exceed amount of $387,960. There is sufficient funding available in the Fiscal Year 2020/21 DOU Operating budget for services through June 30, 2021. Funding for future fiscal years is subject to funding availability in the adopted budget for the applicable fiscal year.
There are no General Funds planned or allocated for this project.
Local Business Enterprise (LBE): WQTS is not an LBE, but has partnered with an LBE, Woodard & Curran, for this contract to meet the minimum LBE participation requirement. Woodard & Curran will provide engineering, data review, QA/QC support for on-call operational services (Task 4), and on-call technical services (Task 5).
