Description/Analysis

Issue Detail: The City has a continuing need for cleanup of waste, debris and property at Department of Utilities (DOU) critical infrastructure.

An increase in the discarded personal property at DOU Water and Drainage critical infrastructure has impacted the day-to-day maintenance operations, the safety of DOU staff, the level of service provided to citizens, and the overall appearance of the waterways. These sites accumulate significant amounts of waste including, but not limited to, bikes, paper trash, and grocery carts, and a coordinated effort is necessary for the disposal of this waste. Waste and debris can further plug screens within waterways causing localized flooding. Additionally, the abundance of human waste and needles found at these sites presents a serious public health risk, especially to our waterways.

This supplemental agreement will allow DOU to continue the expanded and enhanced mitigation activities.

Policy Considerations: This supplemental agreement, including two year extension authority, exceed the City Managers authority and must be approved by the City Council.

Economic Impacts:  None

Environmental Considerations: The activity described in this report has been determined to not be a project pursuant to the California Environmental Quality Act (CEQA). CEQA Guidelines Section 15378(b). The activity is a continuing administrative and maintenance activity [CEQA Guidelines section 15378 (b)] and is not subject to CEQA (CEQA Guidelines Section 15060(c)(3)].

Commission/Committee Action: Not Applicable

Rationale for Recommendation:  In August 2020, Council approved City Agreement PRC001092 to provide cleanup services related to discarded personal property throughout the City, starting September 1, 2020.  Supplemental agreement No. 1 extended the time of performance and lowered the not-to-exceed amount of this contract due to funding constraints.  Supplemental No. 2 will allow the City to continue enhanced cleanup services on City owned vacant lots, public rights-of-way, and all critical infrastructure through June 30, 2021 and give DOU the option to extend the contract for up to two-years. Clean up provided by this contract will enhance the Department’s ability to operate and maintain its facilities during and after the COVID-19 crisis.

Financial Considerations: Supplemental agreement No. 2 will extend the time of performance through June 30, 2021 in an amount not to exceed $195,000 and allow for two additional extension years in an amount not to exceed $400,000 per year for a revised not-to-exceed amount of $1,275,000.

There is sufficient funding in the FY21 DOU Operating Budget in the Water Fund (Fund 6005) and the Storm Drainage Fund (Fund 6011) for this agreement. The agreement will be funded equally by each fund. Funding of this agreement in future fiscal years will be subject to availability of sufficient funds in the budget adopted for the applicable fiscal year.

There are no General Funds allocated or planned for this project.
